Loss of Data: Due to the process or repair, data may be damaged or, at worst, deleted. Simons Systems will make every effort to maintain the integrity of the data contained on your system. Simons Systems is not responsible, however, for the loss of any data which may occur while performing work on your computer. You may request a data backup during service under the terms and conditions below.

Data Backup: For the state price, Simons Systems will attempt to backup the files on your computer to an external medium. While every effort to verify that the files are properly copied, we cannot guarantee any backup. Simons Systems is not responsible for damaged, incomplete, or missing files.

Ownership and Authority: You must demonstrate ownership of any and all software that is to be installed or reinstalled on your computer. You must provide the original software media and any authentic activation keys. Also, Simons Systems assumes that you are the owner of all equipment checked in or are otherwise duly authorized to make decisions regarding the service of that equipment.

Total Cost of Repair: Simons Systems is responsible for providing a pricing estimate upon check-in. The quote provided is good for a period of seven days, since part costs and availability are constantly subject to change. Should costs of repair exceed the pricing estimate; Simons Systems will make every effort to contact you for approval before proceeding with repairs. Part costs are non-refundable after approval. If the part is found to be defective, it will be replaced for you under our standard limited warranty below.

Payment and Insurance Work: Payment for initial labour charges is due at check-in. All payment for unpaid parts, labour and other charges is due upon completion of work. This includes work that is covered by insurance. You are solely responsible for remitting payment to Simons Systems. You are also solely responsible for any and all communications with your insurance provider.

Manufacturer Warranties: You affirm that you are aware that authorizing Simons Systems to work on your computer may void the manufacturer’s warranty. In addition, while every effort will be made by Simons Systems to be aware of warranty conditions, you are solely responsible for knowing and understanding what is covered by any warranties on your computer. Parts and labour on a system that is later discovered to have been covered by a manufacturer’s warranty is non-refundable.

Limited Warranty: Simons Systems warrants all work directly related to repairing the problem stated on the front side of the “Customer Engagement form” under the section titled “Agreed work” for a period of sixty days. This limited warranty applies to parts and labour costs only and will not cover any software corruption or errors. Virus, spyware and other malware infections are not warranted.

Liability: The liability of Simons Systems for damages to your computer is limited to any damage which is caused by our negligent acts or negligent omissions as determined by Simons Systems. The liability cost covered is limited to the total price of the repairs performed by Simons Systems. Be aware that certain repairs, including but not limited to virus and spyware removal, may damage software and or data installed on your computer, which may require the installation of your operating system, programs and data.

Impact of Upgrades: Please be advised that it is your responsibility to understand the impact of upgrades to the operating system, applications and software. Such upgrades can lead to incompatibilities and the possible loss of data. Computer hardware and software work together, therefore incompatibilities may not become apparent until a later date. You are solely responsible for contacting the manufacturer of your software and hardware regarding compatibility issues before upgrading.

Abandoned Property: If you are contacted regarding the completion of work or regarding a decision on ordering any parts for your computer and you do not respond within sixty days, your property will be considered abandoned. Simons Systems will remove any parts that it has provided in an abandoned system and recycle the system. Every effort will be made to contact you by phone, email and certified letter in this event.

Unpaid Labour: If any labour remains unpaid and the property unclaimed thirty days after you are contacted regarding the completion of service, Simons Systems can and will assume ownership of the property for the purposes of securing the value of the services and materials provided.

You will be required to sign this documentation prior to and work being carried out, to say that you confirm that the above information is true and correct to the best of your knowledge, and give permission for a Simons Systems technician to remove the aforementioned equipment from your place of work/residence in order to carry out agreed works. The length of time for repair cannot be predicted, and as such, an estimated timescale will be discussed with you prior to carrying out any work on the computer. Payment is required in full upon completion of agreed work before equipment can be released.
